Unlawful arrest due to court staff failure to update the Police National Computer about discharge of an outstanding warrant

 On 4 February 2021, Robert Appleton was obliged to attend his local Magistrates’ Court with regard to an allegation of breach of probation.

Robert attended slightly late and by reason of his non-attendance, a warrant was issued for his arrest.

Robert did then attend and the hearing went ahead.  Robert was told of the warrant but assured by the Judge that it would be withdrawn.

Just before 9am on the 5 February 2021, Robert was out walking when he was subject to a stop check.  Robert was told that there was a warrant out for his arrest and he was therefore arrested

Robert was transported to his local Police Station where he was processed and then incarcerated in a cell.

After several hours, it was established that the Court had failed to withdraw the warrant and he was released.

Following negotiation, the Court Service agreed to pay Robert £2,500 in compensation together with his legal fees.
