On the 29 December 2015, Ian Sanderson appeared in custody before his local court charged with an offence of common assault.
Ian was remanded in custody and detained at his local prison.
On the 15 January 2016, Ian appeared via video link whereupon an application for bail on his behalf was granted.
Notwithstanding the decision of the Court to grant bail, his release was not processed and he remained in detention over the weekend and was not released until Monday 18 January.
Upon investigation, it was established that the relevant bail order was sent through to the Offender Management Unit’s functional mailbox at 17.32 on Friday the 15 January. Unfortunately, the monitoring hours of the mailbox were only 9am – 5pm and therefore the order was received out of hours. Given that, the order was not processed, and Ian’s release was therefore not processed until the next working day which was Monday 18 January.
Following negotiation, the Court Service agreed to pay Ian £1,000 in compensation together with his legal fees.
