In late 2021/January 2022, my client, Mario Romano, was arrested and put before the Court for interfering with a motor vehicle. Given the circumstances, Luton Magistrates’ Court imposed bail conditions including a curfew.
On 14 February 2022, my client ’s bail conditions were varied such that the curfew was lifted. Relevant Court records were updated and notification was automatically sent to Bedfordshire Police to update the PNC.
Notwithstanding this variation, at 04.50 on 25 February 2022, my client was arrested for breach of curfew and transported to Kempston Police Station. According to the Custody Record, my client was arrested for breach of bail.
Mario was then searched and detained at the Police Station until 07.36 whereupon he was transported in handcuffs to the Court. At Court, it was established that my client was not in fact in breach of bail and therefore on that basis, at approximately 12.30pm, he was released having been wrongfully detained for over 12 hours.
Following the issue of Court proceedings, I am pleased to confirm that Bedfordshire Police agreed a settlement of £3,500 together with costs.
*My client’s name has been changed.
